Terms of Service

By using the ScanOrderGo platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users, including "Business Owners" who manage their restaurant profiles and "Customers" who place orders. If you do not agree to these Terms, you may not use the Service.

ScanOrderGo is a platform that allows Customers to view a digital menu, place orders, and facilitate payments with Business Owners. Our service includes a customer-facing ordering interface with features like optional currency conversion, a real-time order management dashboard, a Point-of-Sale (POS) terminal view for staff, and an AI-powered menu generator. We are an intermediary and not a party to any transaction for food or beverages between the Customer and the Business Owner.

You agree not to use the Service to:

• Upload any content that is illegal, harmful, or infringes on the rights of others.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use the Service for any fraudulent activity, including but not limited to, submitting false payment information.
• Disrupt or interfere with the security or performance of the Service.

As a Business Owner, you are solely responsible for:

• The accuracy of your menu, including names, descriptions, prices, and allergen information.
• Fulfilling all orders placed through the platform to a satisfactory standard of quality.
• Handling all customer service inquiries, disputes, and refund requests directly with the Customer.
• Complying with all applicable laws and regulations, including food safety, taxation, and alcohol service laws.
• Securely handling any customer data you have access to through the dashboard.

Business Owners grant ScanOrderGo a license to display the content they upload (such as logos and menu images) for the purpose of operating the Service. Business Owners retain ownership of their content. You may not use the ScanOrderGo name, logo, or other proprietary information without our express written consent.

The Service is provided "as is" and "as available" without any warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free. Features like currency conversion are provided for convenience and are based on third-party data; we do not guarantee their accuracy.

ScanOrderGo is a technology provider. We are not a restaurant, food preparer, or delivery service. As such, we are not responsible for the quality, safety, or legality of the food and beverages provided by Business Owners. Any disputes regarding order quality, service, or payment must be resolved directly between the Customer and the Business Owner.

To the fullest extent permitted by law, ScanOrderGo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of the Service; or (b) any transaction or relationship between a Customer and a Business Owner.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. If we make changes, we will post the revised Terms on the site and update the "Last Updated" date. Your continued use of the Service after the changes have been posted will constitute your acceptance of the new Terms.
